What are “Plaintiffs” and “Defendants”: A “Plaintiff,” or also commonly referred to as a “Petitioner” is the person or entity who files a lawsuit against another. This party, in most cases, has the burden of proving their case to the Court. This party must show to the Court that they are entitled to the relief they are asking for, whether that relief is a monetary award or a declaration by the Court. A “Defendant,” on the other hand, is the person or entity who is being sued and must respond. In most cases, this party must defend themselves against whatever claims the Plaintiff or Petitioner is making. However, in some cases, the lines between “Plaintiff” and “Defendant” are blurred, and both sides might have claims against the other. Whether you find yourself in the position of a Plaintiff or a Defendant, our firm has many years of experience representing both sides of the aisle.
